Hydroxi Injection Technology (Pty) Ltd trading as HIT (Reg No: 2026/788347/07)
Effective date: 1 November 2026
This policy explains how you can cancel an order, return goods and get a refund from Hydroxi Injection Technology (Pty) Ltd trading as HIT (“we”, “us”). It should be read with our Terms of Sale and our Website Terms of Use.
Which rules apply depends on who you are:
- Part A applies if you are a consumer protected by the Consumer Protection Act 68 of 2008 (CPA).
- Part B applies to businesses that the CPA does not cover.
- Part C applies to everyone.
If this policy and our Terms of Sale differ, this policy applies to consumers, because it follows the law. Nothing in this policy or our Terms of Sale takes away rights that the law gives you.
1. Who is a consumer under the CPA?
The CPA protects:
- individuals (natural persons); and
- companies, close corporations, partnerships, trusts and other juristic persons whose asset value or annual turnover is less than R2 million at the time of the transaction (Government Notice 294 of 2011).
The CPA does not apply to a juristic person whose asset value or annual turnover is R2 million or more. Our quote form asks you which group you fall into. If you are not sure, contact us and we will help you work it out.
Part A: Consumers (CPA applies)
2. Cooling-off rights
You may have a cooling-off right, which lets you cancel without giving a reason and without penalty:
- Orders made electronically (ECT Act section 44). If you order by email or by another electronic transaction, you may cancel within seven days after you receive the goods, or within seven days after the agreement is concluded for services. The only cost you may have to pay is the direct cost of returning the goods. We will refund you in full within 30 days of the date you cancel. This is the same right described in our Website Terms of Use.
- Orders that result from direct marketing (CPA section 16). If you buy because we approached you directly (in person, by phone, by post or electronically), and section 44 of the ECT Act does not apply, you may cancel in writing within five business days after the agreement was concluded or the goods were delivered, whichever is later. We will refund you within 15 business days after we receive your notice or, if goods were delivered, after we receive the goods back.
Some exceptions apply under section 42(2) of the ECT Act, for example to services that began with your consent before the seven days ended, and to goods made to your specifications. We will tell you before you order if we believe an exception applies to your order.
3. Cancelling an order or installation booking (CPA section 17)
You may cancel an order or an installation booking before we deliver or install.
- If you have not paid anything, you can cancel at no cost (Terms of Sale, clause 5.1).
- If you have paid a deposit, we may keep a reasonable cancellation charge. It will not be more than a fair amount, considering the type of goods or services, how much notice you gave us, whether we can reasonably use the goods or the booked time for another customer, and normal industry practice. We refund the rest of your deposit.
- We will not charge any cancellation fee if you cannot go ahead because of the death or hospitalisation of the person for whom the order or booking was made.
- Section 17 does not apply to special orders. A special order is a custom-built or modified kit made for your vehicle or equipment. If your order is a special order, we will say so on your quotation, and the terms on that quotation and in our Terms of Sale apply, subject to any cooling-off right in section 2.
If your order takes longer than 120 days, you may also ask in writing for your deposit to be refunded with interest, as set out in Terms of Sale, clause 4.5.
4. Returning goods that have not been installed (CPA section 20)
You may return goods and get a full refund within 10 business days after delivery if:
- you told us the particular purpose you needed the goods for, and they turn out to be unsuitable for that purpose;
- you could not examine the goods before delivery and you reject them because they do not match what you ordered; or
- you cancelled during the direct-marketing cooling-off period in section 2.
These return rights do not apply once goods have been permanently installed, fitted or attached to a vehicle, engine or other equipment. Your rights for defective goods in section 5 still apply after installation.
If the goods are returned unopened in their original packaging, we will not deduct anything. If they have been opened or used, we may deduct a reasonable amount for use or for restoring them to a condition fit for resale, as the CPA allows.
5. Defective goods (CPA sections 55 and 56)
Under the CPA, every product we supply to you must be of good quality, in good working order, free of defects, safe, and reasonably suitable for its normal purpose.
If a product does not meet these standards within six months after delivery, you may return it to us, without penalty and at our risk and cost. You then choose whether we:
- repair it;
- replace it; or
- refund the price you paid for it.
If we repair it and the same problem is not fixed, or a new defect appears, within three months after the repair, we must replace the product or refund you.
Where the product is installed in your vehicle or equipment, we inspect it either at your site or at our workshop, as we choose. During this six-month period we arrange and pay for the inspection, removal and refitting, and for any collection and transport of the product or vehicle.
Our own warranty of one year from the installation date (Terms of Sale, clause 11.3) is in addition to these rights. It does not replace or shorten them.
6. Installation work (CPA section 54)
We guarantee our installation work (Terms of Sale, clauses 7.3 and 11.6). If our installation is faulty, for example if it leaks, we will put it right at our own cost. If it cannot be put right, you may ask for a refund of a reasonable part of the installation price, depending on the extent of the problem.
If you are entitled to a full refund of the product, we will remove it at our cost. [PENDING RONNIE – Q65: whether the installation price is also refunded in full]
7. What our CPA obligations do not cover
The implied warranty does not cover a fault to the extent that it was caused by:
- the product being altered, opened or repaired by someone other than us, against our instructions;
- installation by someone other than us (see Terms of Sale, clause 11.5);
- an accident, misuse, abuse or neglect, or use that does not follow our operating and maintenance instructions;
- normal wear and tear.
A broken seal or other sign of tampering does not by itself cancel your CPA rights. We will inspect the product and look at whether the alteration actually caused the problem.
Part B: Businesses not covered by the CPA
8. Cancellation
For businesses with an asset value or annual turnover of R2 million or more, our quotation and Terms of Sale apply:
- You may cancel an order at no cost if no payment has been made (Terms of Sale, clause 5.1).
- Once a deposit has been paid, the order cannot be cancelled, except as set out in Terms of Sale, clause 4.5 (refund of the deposit with interest if the order takes longer than 120 days) (Terms of Sale, clause 5.3).
- An order cannot be cancelled because of problems with the installation (Terms of Sale, clause 5.2). Installation problems are fixed under our installation guarantee (Terms of Sale, clauses 7.3 and 11.6).
- Returning unused goods that are not a special order: [PENDING RONNIE – Q38: restocking or handling fee, or none]
The ECT Act section 44 cooling-off right applies only to consumers as defined in the ECT Act [CONFIRM – attorney to check whether any business customers qualify].
9. Warranty claims
Our warranty is set out in Terms of Sale, clause 11. In short:
- Products are warranted against defects in workmanship and materials for one year from the original installation date (clause 11.3).
- The warranty applies only if we installed the product (clause 11.5).
- The warranty does not cover transport costs and is limited to product material and workmanship (clause 11.7).
- You must notify us of a defect in writing within one year after the installation date. Inspections and repairs take place at our premises (clause 11.8).
Our liability is limited to repairing or replacing the product or the defective part (clause 11.8).
Part C: For everyone
10. How to cancel, return or claim
Please contact us in writing:
- Email: info@hit.africa
- Phone: +27 (0) 84 588 6750
- Address: 2 Heron Drive, Sheffield Estate, Vintage Drive, White River [CONFIRM: postal code]
Please include:
- your name, company name (if any) and contact details;
- your quotation or invoice number;
- whether you are cancelling, returning goods or claiming under the warranty;
- for a defect, a short description of the problem and, if possible, photos;
- proof of purchase, such as your invoice or warranty certificate.
For a cooling-off cancellation, you do not need to give a reason.
We will acknowledge your request within [PENDING RONNIE – Q43: acknowledgement time] business days and tell you the next steps.
11. Inspection and condition of returned goods
We may inspect returned goods, or goods you say are defective, to confirm their condition and the cause of any fault. Please do not try to remove an installed unit yourself. We will arrange removal.
Unused goods should be returned complete, with all parts, manuals and packaging where possible.
12. Refunds
- We refund by electronic funds transfer (EFT) to the bank account you nominate in writing.
- We pay refunds within the time the law requires: 30 days for an ECT Act cooling-off cancellation, 15 business days for a CPA direct-marketing cancellation, and otherwise within [PENDING RONNIE – Q43: refund time] business days after we accept the refund or receive the goods back.
- Deposit refunds under Terms of Sale, clause 4.5 are paid within 30 days after the date of your letter, with interest as set out in that clause.
- We do not charge a fee to process a refund.
13. Consumables
Consumables, such as distilled water, are sold separately. We sell distilled water, and you may also buy it locally. Opened consumables can only be returned if they are defective, or if the law otherwise allows it. This does not affect your CPA rights.
14. Savings and pilot agreements
We do not offer a general savings guarantee, because results vary by vehicle, engine, load and operating conditions. If you start with a pilot, any savings target, how it is measured, and what happens if it is not met are set out in a pilot agreement that we both sign before installation. Only those written terms apply (Terms of Sale, clause 11.2).
15. Disputes
If you are not happy with how we handled your request, please let us know so that we can try to resolve it. Consumers may also approach the Consumer Goods and Services Ombud (https://www.cgso.org.za, 0860 000 272, info@cgso.org.za) or the National Consumer Commission.
Section 14 of our Website Terms of Use explains which courts may hear a dispute. If you are a consumer, you may always refer a dispute to any court with jurisdiction, including a Magistrate’s Court or Small Claims Court.
16. Changes to this policy
We may update this policy from time to time. The version that applied on the date of your order applies to that order, unless a later version gives you more rights. The latest version will always be on this page, with its effective date.
