3. What personal information we collect
We only ask for what we need. Depending on how you deal with us, we may collect:
- Contact details: your name and surname, email address, phone or WhatsApp number, company name and job title.
- Vehicle and equipment details: fuel type, engine size, make and model, generator size, how the vehicle or machine is used, fleet size, distance or hours run, and fuel use.
- Customer type: whether you buy as an individual or as a business, and whether your business has an asset value or annual turnover of R2 million or more. We ask this on our quote form so that we apply the right consumer rules to your order.
- Quote, order and payment records: quotes, purchase orders, invoices, proof of payment, delivery and installation details, and warranty records. We do not take payments on our website.
- Installation and site assessment records: site address, vehicle registration or fleet numbers, measurements, photos, and test and warranty certificates.
- Messages: what you tell us by email, WhatsApp, phone or through forms on our website.
- Marketing preferences: whether you have agreed to receive updates from us, and when.
- Technical information: your IP address, browser and device type, pages visited and similar data collected through cookies and analytics, where you allow it. See our Cookie Policy.
We do not ask for special personal information (such as health, religion or biometric data) and ask you not to send it to us.
4. How we collect it
- Directly from you, when you fill in a form on our website (for example a quote request or fleet report request), email us, phone us or send us a WhatsApp message.
- Through the compatibility checker. The checker works in your browser and does not save your answers. If you choose “Chat on WhatsApp” or “Email our engineers”, your answers (fuel, engine size, make and model, use) are placed into a WhatsApp or email message that you can read and edit before you send it. When you send it, we receive the message together with your WhatsApp number and profile name, or your email address.
- Through the savings calculator. The calculator works in your browser with the figures you enter. If you then ask for a quote or a fleet report, the figures you entered and the calculator’s results are sent to us with your request, and we use them to prepare your quote. A fleet report is emailed to you as a PDF, with a copy to our sales team.
- When you ask for a quote, accept a quotation, place an order, or arrange a site assessment or installation with us. We do not take online bookings or online payments on our website.
- Automatically, through cookies and similar technologies, where you allow it.
- From third parties you have referred us to or who refer you to us, such as a financier or your employer’s fleet manager [CONFIRM].
5. Why we use it and our lawful grounds
Under section 11 of POPIA we may only process personal information on a lawful ground. We use your personal information to:
- Answer your questions and check whether our system is likely to suit your engine (your consent, or steps you ask us to take before a contract).
- Prepare quotes, fleet reports and site assessments (steps you ask us to take before a contract, and your consent where you tick a consent box).
- Confirm whether you are a consumer under the Consumer Protection Act, so that we apply the right cancellation, refund and warranty rules (legal obligation, and steps you ask us to take before a contract).
- Process orders, payments, delivery, installation and warranty claims (to perform our contract with you).
- Keep accounting and tax records and meet other legal duties (legal obligation).
- Run, secure and improve our website, and understand how it is used (our legitimate interests; for non-essential cookies and analytics, your consent).
- Send you updates and offers (your consent, or the existing-customer rule; see section 6).
- Protect our rights, prevent fraud and resolve disputes (our legitimate interests or legal obligation).
Where we rely on your consent, you may withdraw it at any time. This does not affect processing that took place before you withdrew it. Where we rely on our legitimate interests, you may object (see section 12).
6. Direct marketing
We follow section 69 of POPIA for marketing by email, SMS, WhatsApp and similar electronic messages.
- We will only send you electronic marketing if you have opted in (for example, by ticking “Send me occasional Hydroxi updates (optional)”), or if you are an existing customer and the message is about our own similar products or services.
- Every marketing message, whether by email, SMS or WhatsApp, will tell you who it is from and include a way to opt out, such as an unsubscribe link or our contact details. Opting out is free, apart from your own data or call costs.
- If you opt out, we will stop sending you marketing. We may still contact you about your quote, order, installation or warranty.
To opt out at any time, use the unsubscribe link in any marketing message, or email info@hit.africa and ask us to stop. You may also object to direct marketing at any time under section 11(3) of POPIA.
7. Who we share it with
We do not sell your personal information. We share it only where needed, with:
- Operators who process information on our behalf: our website hosting and email provider (Afrihost), our quote and customer management system (Odoo) [CONFIRM: Odoo in use at go-live], WhatsApp (Meta) when you message us, website analytics (Google Analytics, only if you accept analytics cookies) and IT security tools.
- A financier, if you ask us to refer you for finance. The financier’s own terms and privacy policy then apply.
- Our professional advisers (such as auditors and attorneys), and authorities such as SARS, where the law requires it.
Under sections 20 and 21 of POPIA, our operators must process your information only on our instructions, keep it confidential and apply proper security safeguards. We put written agreements in place with them for this purpose.
8. Transfers outside South Africa
Some of our service providers store or process information on servers outside South Africa. For example, WhatsApp (Meta) and Google may process data in the United States, the European Union or other countries, and Odoo may store our quote and customer records outside South Africa [CONFIRM: Odoo data location].
Under section 72 of POPIA we only transfer personal information outside South Africa where:
- the recipient is subject to a law, binding corporate rules or a binding agreement that gives protection substantially similar to POPIA; or
- you have consented to the transfer; or
- the transfer is needed to perform a contract with you, or to take steps you have asked for before a contract, or is otherwise allowed by section 72.
9. How we keep it safe
As section 19 of POPIA requires, we take reasonable technical and organisational measures to protect your personal information against loss, damage and unauthorised access. These include encrypted connections (HTTPS) on our website, named user accounts with access limited to what each person needs, two-step login for all website administrator accounts, security software, regular backups and software updates.
No system is completely secure. If we have reasonable grounds to believe that your personal information has been accessed or acquired by an unauthorised person, we will notify the Information Regulator and you as soon as reasonably possible, as section 22 of POPIA requires.
10. How long we keep it
Under section 14 of POPIA we keep personal information only as long as we need it for the purpose we collected it for, unless the law requires or allows us to keep it longer. In general:
- Enquiries and quotes that do not lead to an order: 24 months from our last contact with you.
- Customer, order, invoice and warranty records: for as long as needed for the contract and warranty, and then as long as tax and company law require [CONFIRM: retention period with our accountant].
- Marketing preferences and opt-outs: for as long as needed to respect your choice.
When we no longer need it, we delete or destroy it, or de-identify it so that it can no longer identify you.
11. Automated results
The compatibility checker and savings calculator give automatic indications only. They do not make any decision about you. An engineer confirms whether our system suits your engine before any quote or order.
12. Your rights
Under POPIA you have the right to:
- ask whether we hold personal information about you, and ask for a copy of it (section 23);
- ask us to correct or delete personal information that is inaccurate, out of date, incomplete, excessive, misleading or unlawfully obtained, or that we are no longer allowed to keep (section 24);
- object, on reasonable grounds, to us processing your personal information based on our legitimate interests, and object at any time to direct marketing (section 11(3));
- withdraw your consent at any time, where we rely on consent;
- complain to the Information Regulator (see section 13 of this policy).
To use these rights, contact our Information Officer using the details in section 2. We may need to confirm your identity before we act on a request. If you only want to know whether we hold personal information about you, you can ask us free of charge under section 23(1)(a) of POPIA. Requests for access to records are handled under PAIA, using the forms and process set out in our PAIA manual. A prescribed fee may apply to other access requests; we will tell you about it before we proceed.
